Introduction

Your privacy is our business. Foxway protects your privacy by making sure to collect and handle personal information in a responsible way. Our privacy policy takes dives deep into exactly how Foxway collects and uses your personal information. It’s highlighting your rights when it comes to personal data and how you can argue your rights. 

”Foxway”, ”we” ”our”, or ”us” refers to Foxway AB registered with the Swedish Companies Registration Office. Our organization number is 556470-0309 and our head office is at Grusåsvägen 7 in Växjö, Sweden. In accordance with EU data protection legislation, we are responsible for the personal data that you provided us with, or that we collected from you. All processing of your personal data by Foxway is done in accordance with applicable data protection legislation.

Personal data

Who is responsible for your personal data?

Foxway is responsible for the personal data collected and processed by us and our subcontractors within the framework of our services (the “Foxway Services”) and for the processing of personal data through our digital channels, such as this website and/or other future digital touchpoints.

Kinds of personal data processed

Personal data is information which helps to identify a person and therefore information that can be led back to a person. It includes name, telephone number, address, e-mail, username, profession and purchase history. Foxway also use cookies so that you do not have to log in every time you visit our website for example. More detailed information on how we use cookies can be found under the section ”Cookies” below. Please note that information about purchase history in relation to a specific corporate customer is linked to the corporate customer, and not to you as a contact person.

We can also collect person data from your device that can tell us if you are browsing from a computer or mobile phone and the browser that you are using. We also collect data on how you use Foxway Services, information about the features you use, the websites that you visit and the software configuration that you use. This may also include information about IP address and settings.

How do we collect your personal data?

We collect personal data when you use Foxway Services or in any other way interact with us. The data is collected through the following procedure:

Information that you share with us. When you register yourself as a user/customer, log in to our website and contact our customer service for support. When you sign up for our newsletter, one of our events, apply for a job with us or perform other activities within the framework of the Foxway Services when providing information about yourself, such as name, phone number, email address and content of messages. Personal data is usually provided by you actively providing us with filled out online forms, send emails or give us feedback through features created for that purpose. 

Some personal data is collected by analyzing the way you interact with Foxway Services and our products, such as website cookies and information (IP address, language settings and push notification settings) that we get from the way you use your device (mobile phone, computer or tablet) when using Foxway Services. 

What do we do with your data? 

The reason for processing personal data is to improve the Foxway Services for you. That we have the opportunity to (1) provide and administrate your access to Foxway Services, (2) fulfill our contractual and legal obligations, (3) to answer customer service issues, (4) improve your user experience, (5) send you information and direct marketing through email or any other way, (6) further develop the Foxway Services and (7) prevent, limit and investigate misuse of Foxway Services. 

The processing of personal data in accordance with points 1 to 3 above is done with fulfillment of an agreement as a legal basis (if the processing is necessary to fulfill our contractual obligations to you) or a legitimate interest. The processing of personal data in accordance with points 4 to 7 above is done with a legitimate interest as a legal basis, where Foxway’s legitimate interest is to be able to exercise its rights and obligations under the agreement with the customer company and to market our products and services.

How long do we store your personal data?

Foxway will take reasonable steps to store personal data only for as long as necessary in order to fulfill the purposes of which it was collected in the first place. Otherwise we will delete personal data in accordance with applicable law. We store your personal data for as long as it’s necessary for us to be able to fulfill our commitment, i.e. provide Foxway Services, invoice or handle complaints. If you have agreed that your contact information should be stored in our client register for marketing purposes, it will be stored up to 36 months after customer relationship has ended if you don’t request your personal data to be deleted before then.  

Who can we share your information with?

Foxway may share your personal data to partners who perform services on behalf of Foxway. These recipients only have the right to process your personal data in connection with performing a service for Foxway, e.g. to deliver an ordered item to you or to send marketing or newsletters. We require these providers to protect your personal information in accordance with this Privacy Policy and not use or disclose your personal information for any purpose other than to provide us with agreed products or services. We may also disclose your personal information to authorities, such as the Swedish Tax Agency, if we are required by law to do so. In the event that all or part of our business is sold, we may share your personal information to a potential buyer of the business.

Transaction to third countries

Foxway primarily processes personal data within the EU/EEA, but in some cases, use suppliers that are established in a third country (i.e. a country outside the EU/EEA), for data storage, and system maintenance that gives the supplier access to personal data. In the event that data is shared to suppliers in third countries, this will only happen when Foxway has legal support, e.g. by signing the European Commission’s standardized model clauses. Foxway will also require these providers to (1) protect your personal information in accordance with this Privacy Policy and (2) not use or disclose your personal information for any purpose other than to provide us with agreed products or services.

Security

Foxway takes all appropriate security measures necessary to protect your personal data from unauthorized access, alteration or destruction. However, it always involves a risk of disclosing personal data via digital channels as it is not entirely possible to protect computer systems from intrusion.

Your rights

You have the right to contact Foxway at any time in order to exercise your rights under applicable data protection laws.

The right to access extracts and correction: You have the right to request information free of charge once every calendar year about which (if any) personal data we process about you and also have any incorrect information corrected.

The right to be forgotten: You have the right to request the deletion of your personal data in the event that the data is no longer necessary for the purpose for which it was collected (the right to be forgotten). Depending on which data that gets deleted, Foxway may no longer be able to provide certain services to you.

The right to information: You have the right to receive information about how your personal data is processed. This is done through this Privacy Policy.

The right to limit the processing of your personal data: You have the right to limit the personal data. In such a case, the processing of your personal data may only take place for certain limited purposes.

Right to object against Foxway’s processing of personal data: You have the right to object to Foxway’s processing of your personal data under certain conditions. The right to object applies to e.g. if the processing is based on a balance of interests, unless we can demonstrate (1) compelling legitimate reasons for the processing that outweigh your interests, rights and libirties, or (2) if the processing takes place for the determination, exercise or defense of legal claims.

Right to object to marketing: You have the right to object Foxway’s processing your personal data for marketing. If you object to this, Foxway has to discontinue all marketing to you without undue delay. 

The right to data portability: You have the right to request a copy of the personal data you have provided to us in a structured, common and machine-readable format. You also have the right to request that Foxway share this personal data to another personal data controller. The right to data portability applies to personal data that is processed in an automated way, which is based on your consent or through an agreement to which you are a party.

External links

In our digital channels, there may be external links to other websites provided by other companies outside the Group. This privacy policy does not apply to these websites and you should therefore read the privacy policies of those websites before disclosing personal information.

What are cookies?

Cookies are small text files that are sent from our web server to be saved in your browser when you visit our website. The reason behind cookies is to improve your experience of our website. In your browser, you can change the settings for how cookies are allowed to be used or to ensure that cookies are always discarded when you close your browser.

These cookies are necessary for the website to function as intended and can’t be turned off in our systems. Functional cookies

Functional cookies make it possible to save information that can change the appearance or functions of the website. In our forms on the website, we use the third-party tool Hubspot. Here we collect personal data about you to keep track of information that the visitor has provided in the form. That way we will have the opportunity to deliver more relevant information to the visitor.

Statistical cookies

Statistical cookies make it possible for Foxway to understand how our visitors interact with the website. We use Google Tag manager as a statistics tool for our website. Foxway uses it to be able to see the number of visitors to the website, where the visitor comes from and which sites have been visited. The information collected is anonymous.

Marketing cookies

Marketing cookies are used to track visitors cross-border on websites. These cookies contain information about how you interacted with our website. For example, which pages you visited and the links you clicked on. Our purpose is to show ads that are of interest to the individual user and that are more valuable to Foxway and third-party advertisers. Foxway uses targeted ads via the Google Marketing Platform, Facebook, instagram and Linkedin.

1. Introduktion

Denne fortrolighedspolitik beskriver, hvordan vi behandler dine personoplysninger med henblik på at levere Samsung Flex (“Programmet“), når du kontakter os eller en af vores partnere om Programmet. Her kan du læse mere om, hvilke personoplysninger vi indsamler, hvordan og hvorfor vi bruger dine personoplysninger, og hvordan du kan udøve dine rettigheder.

Bemærk venligst, at denne politik er specifik for Programmet, og at vi også har en generel politik om beskyttelse af personlige oplysninger, som beskriver Foxways andre tjenester, herunder besøgende på vores websted og erhvervskunder. Programmet er en tjeneste til leje og køb af mobiltelefoner (“Enheder“) under Programmet, der udbydes af Foxway AB, Grusåsvägen 7, Växjö (556470-0309) (“Foxway“, “vi“, “os“), hvor betingelser fra Samsung Electronics Nordic AB, Torshamnsgatan 48, Kista (556445-4345) (“Samsung“) også finder anvendelse, uden at Samsung er en el af Aftalen i forhold til leje eller køb af mobiltelefoner. Foxway og Samsung er fælles dataansvarlige for behandlingen af personoplysninger, der udføres i forbindelse med programmet. Foxway er primært ansvarlig for at behandle de personoplysninger, der er nødvendige for at levere og administrere Programmet. Samsung er primært ansvarlig for behandlingen af de personoplysninger, der er nødvendige for at yde den aftalte support og reagere på andre hardwarerelaterede problemer i forhold til Enheder.

• Hvad er personoplysninger?

Ved personoplysninger forstås alle oplysninger, der kan bruges til at identificere dig, f.eks. dit navn, dit personnummer, din adresse, e-mail, telefon eller e-mailadresse.

• Hvordan bruger vi dine personlige oplysninger?

Vi bruger dine personlige oplysninger til følgende formål.

• Behandling er nødvendig af hensyn til opfyldelse af en kontrakt. Vi har brug for at behandle en række personoplysninger, f.eks. dit navn, dit personnummer og dine kontaktoplysninger for at kunne opfylde den kontrakt, vi har indgået med dig om leje af enheden og med henblik på at fakturere for lejen af Enheden, jf. databeskyttelsesforordningens artikel 6 (1)(b).
• Fakturering og betalinger. Vi behandler dit navn, dit personnummer og dine kontaktoplysninger, faktureringer og betalinger for at kunne dokumentere som krævet i henhold til bogføringsloven, jf. databeskyttelsesforordningens artikel 6 (1)(c).
• Kommunikere og yde støtte. Vi behandler dine kontaktoplysninger og oplysninger, som du giver i kommunikationen med os, for at behandle og besvare dine anmodninger, jf. databeskyttelsesforordningens artikel 6 (1)(b).
• Afgøre, om du har ret til at bestille en Enhed. Inden Foxway med hjælp fra tredjeparter godkender din bestilling af en enhed, foretager Foxway en kreditvurdering af dig for at fastslå, om du opfylder de til enhver tid gældende krav til berettigelse til at bestille en enhed. Hvis Foxway har grund til mistanke om svindel eller andre ulovlige eller skadelige aktiviteter, forbeholder vi os retten til at udføre yderligere kreditvurdering under det igangværende kontraktforhold.Vi indhenter kun oplysninger om, hvorvidt du som kunde er kreditværdig eller ej, hvor vi anvender dit personnummer, jf. databeskyttelseslovens § 11, stk. 2, nr. 3.
• Returneringer og påmindelser i forbindelse med kontraktens udløb. Vi behandler dine kontaktoplysninger for at kunne kontakte dig i forbindelse med returnering af en enhed eller med en påmindelse før programmets afslutning, dvs. for at du kan beslutte, om du ønsker at købe eller returnere den lejede enhed eller indgå en ny kontrakt med os, jf. databeskyttelsesforordningens artikel 6 (1)(b).
• Anonymisering af personoplysninger til statistiske formål. Personoplysninger, som vi indsamler i forbindelse med levering af programmet, kan anonymiseres med henblik på at udarbejde relevante aggregerede statistikker. Disse statistikker kan bl.a. bruges til at udvikle og forbedre vores tjenester. Bemærk venligst, at de endelige anonymiserede oplysninger ikke vil indeholde nogen personoplysninger, jf. databeskyttelsesforordningens artikel 6 (1)(f).
• Beskyt os og vores tjenester. Vi behandler dine personoplysninger for at dokumentere overholdelse af lovkrav, beskytte vores rettigheder og forhindre svindel og andre ulovlige eller skadelige aktiviteter, der kan påvirke os, vores tjenester eller andre kunder, jf. databeskyttelsesforordningens artikel 6 (1)(f).
• Hvilke personoplysninger vil vi behandle?

De data, vi indsamler om dig, afhænger af de tjenester, du bruger, og de data, du vælger at dele med os. Til de formål, der er beskrevet ovenfor, kan vi behandle følgende typer personoplysninger, som du giver os:

• Kontaktoplysninger såsom navn, e-mail, adresse og telefonnummer.
• Personnummer
• Betalingsoplysninger
• IP-adresse og omtrentlig lokation hvorfra bestilling afgives i forbindelse med din bestilling af en Enhed.
• Andre oplysninger, som du giver i kommunikationen med os, f.eks. i forbindelse med støtte til returnering af en enhed eller en forespørgsel, som du har til os vedrørende programmet.

Ud over de oplysninger ovenfor, som du deler med os, kan vi indsamle og gemme følgende personoplysninger fra andre kilder:

• Kreditoplysninger, som vi indsamler fra Svea Bank til brug for kreditvurdering.
• Hvorfor bruger vi dine data?

Udførelse af kontrakter

De fleste af de ovenfor beskrevne behandlinger er nødvendige for, at vi kan levere programmet og opfylde det, vi har aftalt i henhold til vores kontrakt med dig.

Balance af interesser

Nogle behandlinger er baseret på en såkaldt interesseafvejning, hvilket betyder, at vi har en legitim interesse i at bruge oplysningerne til et bestemt formål. For at en interesse kan betragtes som legitim i henhold til loven, må formålet og behandlingen ikke tilsidesætte dine grundlæggende rettigheder eller frihedsrettigheder. Når vi bruger personoplysninger på grundlag af en interesseafvejning, har vi vurderet, at brugen ikke vil krænke dine rettigheder eller frihedsrettigheder. Vi mener f.eks., at vi har en legitim interesse i at indsamle kreditoplysninger via en tredjepart for at kunne foretage en finansiel risikovurdering af vores evne til at indgå en kontrakt med dig.

Juridisk forpligtelse

Ud over ovenstående kan vi også have brug for at indsamle og opbevare personoplysninger for at overholde visse juridiske forpligtelser, som vi er underlagt, fx overholdelse af bogføringsloven.

• Hvem har adgang til dine personlige oplysninger?

Samsung Electronics Nordic AB

Som beskrevet i det indledende afsnit i denne politik er det program, som Foxway leverer i henhold til aftalen, et samarbejde mellem Foxway og Samsung. Det betyder, at dine personlige oplysninger vil blive delt mellem virksomhederne, i det omfang det er nødvendigt for at levere programmet, f.eks. i forbindelse med et løbende supportproblem.

Andre leverandører, der hjælper os med at levere programmet

Nogle gange er det også nødvendigt for os at bruge eksterne tjenesteudbydere for at kunne levere programmet. Vi bruger eksterne tjenesteudbydere til at fakturere dig for enheden og til at indhente kreditrapporter. Vi vil altid kontrollere og være ansvarlige for vores underleverandørers brug af dine personlige oplysninger.

Myndigheder

Vi deler personlige oplysninger med offentlige myndigheder eller andre tredjeparter, når det kræves i henhold til lov eller regler, eller når det er nødvendigt for at beskytte eller forsvare vores rettigheder og interesser eller vores brugeres, medarbejderes, direktørers eller aktionærers rettigheder og interesser og/eller for at opretholde sikkerheden i vores tjenester.

I tilfælde af fusion, overtagelse eller salg

I tilfælde af at vi bliver fusioneret eller solgt (helt eller ved tilstrækkelig succession), vil dine personlige oplysninger blive delt med eller overført til den fusionerende eller overtagende enhed. I så fald vil dine personoplysninger fortsat blive behandlet i overensstemmelse med denne privatlivspolitik.

• Hvordan beskytter vi dine personlige oplysninger?

Vi tager adskillige skridt for at holde dine personoplysninger sikre og beskyttet mod uautoriseret eller ulovlig behandling og mod utilsigtet tab, ødelæggelse eller beskadigelse. Vi træffer både tekniske og organisatoriske foranstaltninger for at beskytte dine personoplysninger ved hjælp af adgangskontrol, autoriseringskontrol og krypteringsprocedurer. Vi sikrer også, at vores tredjepartsleverandører anvender passende sikkerhedsforanstaltninger.

• Hvor opbevares dine personlige oplysninger?

De personoplysninger, som vi indsamler om dig, behandles og opbevares hovedsageligt i EU. Da vi bruger leverandører, der er etableret i lande uden for EU, kan dine personoplysninger også blive overført til disse lande. Inden vi overfører personoplysninger uden for EU, sikrer vi, at der er truffet passende sikkerhedsforanstaltninger til at beskytte dine personoplysninger, f.eks. ved at anvende de standardkontraktbestemmelser, der er godkendt af Europa-Kommissionen, sammen med yderligere sikkerhedsforanstaltninger. Du kan altid anmode om en kopi heraf.

• Hvor længe opbevarer vi dine personlige oplysninger?

Hvor længe vi opbevarer dine personoplysninger varierer afhængigt af det formål, som vi har indsamlet dem til. Dine personoplysninger bruges så længe, som det er nødvendigt for at opfylde det formål, som vi indsamlede dem til. Formålet med dataindsamlingen er beskrevet under “Hvordan bruger vi dine personlige oplysninger?”.

I nogle tilfælde kan vi have brug for at opbevare dine data længere for at overholde gældende love, fx 5 år efter udløbet af det regnskabsår hvor transaktionen (køb/betaling) blev foretaget med henblik på at dokumentere i henhold til bogføringsloven. Vi kan også have brug for at opbevare dine personoplysninger for at muliggøre tvistbilæggelse og for at beskytte vores legitime interesser.

Vi vil også gerne informere dig om, at i tilfælde af at samarbejdet mellem os og Samsung ophører, kan Samsung fortsætte med at behandle dine personoplysninger i overensstemmelse med Samsungs gældende privatlivspolitik på det tidspunkt.

1. Hvilke rettigheder har du i forbindelse med dine personoplysninger?

Du har altid følgende rettigheder i forbindelse med dine personoplysninger:

• Ret til indsigt (registeruddrag) – en ret til at få adgang til oplysninger om, hvilke personoplysninger vi behandler om dig.
• Ret til berigtigelse – en ret til at få urigtige personoplysninger om dig selv rettet.
• Ret til sletning – en ret til at få dine personoplysninger slettet under visse betingelser.
• Ret til begrænsning af behandling – en ret til at få begrænset behandlingen af dine personoplysninger, indtil unøjagtige oplysninger er blevet rettet eller andre indsigelser er blevet løst.
• Ret til dataportabilitet – en ret til at anmode om overførsel af personoplysninger fra en dataansvarlig til en anden. Denne ret er begrænset til de oplysninger, som du selv har givet os.
• Ret til at gøre indsigelse – en ret til at gøre indsigelse mod behandlingen af dine personoplysninger på grundlag af vores legitime interesser (interesseafvejning).

Du kan udøve dine rettigheder som beskrevet ovenfor ved at sende en anmodning til gdpr@foxway.com. Vi besvarer din anmodning inden for 30 dage. Bemærk venligst, at der kan være krav og bestemmelser, der begrænser dine rettigheder, f.eks. kan der være juridiske eller kontraktlige forpligtelser, der forhindrer os i at videregive, blokere eller slette dine oplysninger.

Vi har altid til hensigt at behandle enhver henvendelse eller klage på en lovlig, retfærdig og gennemsigtig måde. Hvis du mener, at dine rettigheder er blevet krænket, kan du imidlertid indgive en klage til den relevante myndighed (i Danmark det danske datatilsyn https://www.datatilsynet.dk), hvis du mener, at vores behandling af dine personoplysninger er i strid med gældende lovgivning.
